This website and online store are operated by Productos Como En Casa, LLC, doing business as MODOCasa. By using the site or placing an order, you agree to these Terms and the policies linked below. If you do not agree, do not use the store.

1. Use of the store

You must be at least 18 years old or use the store with the permission of a parent or legal guardian. You agree to provide accurate information, use the store lawfully, and not interfere with its security or operation. We may restrict access or refuse service for misuse, fraud, or other lawful reasons.

2. Products and information

Our Shopify catalog features Comfort Bakes banana breads and Kitchen Secrets seasonings, dry rubs, salts, and bundles. Product availability can change, and seasonal items may be offered for a limited time.

We aim to keep descriptions, prices, and photographs accurate. Packaging, presentation, and color may vary. If a material listing or pricing error affects an order, we may contact you to correct the error or cancel and refund the affected order.

Check product labels for ingredients, allergens, storage instructions, and use instructions before consuming a product. If you have an allergy or a question about an ingredient, contact us before ordering. Website descriptions are not a substitute for the label on the product received.

3. Orders and payments

Orders are subject to availability and acceptance. An order-confirmation email acknowledges receipt of your order. If we cannot fulfill an order, we will notify you and refund any payment collected for the canceled items.

Prices are shown in U.S. dollars unless stated otherwise. Applicable shipping charges and taxes are displayed at checkout. Payments are handled through Shopify and the payment providers offered at checkout. Payment must be received before shipment.

4. Discounts and promotions

Promotions are subject to the conditions displayed with each offer. Eligibility, minimum purchase amounts, permitted combinations, and usage limits may apply. Discounts do not apply retroactively unless expressly offered.

Free-shipping eligibility is based on the merchandise subtotal after discounts. An order discount can reduce the subtotal below the free-shipping minimum. Review the final checkout total before completing your purchase.

5. Shipping and pickup

Comfort Bakes ships only within Texas at this time. Kitchen Secrets ships within the United States. Shipping rates, free-shipping conditions, processing times, multiple-package shipments, and market-pickup arrangements are described in our Shipping Policy.

Carrier transit estimates can be affected by weather, operational disruptions, or other circumstances beyond our control. We will review delivery issues under our Shipping and Refund Policies and applicable law.

6. Returns, refunds, and cancellations

Food returns, issue-reporting requirements, cancellation requests, and refund processing are governed by our Return & Refund Policy. Nothing in these Terms limits rights that cannot lawfully be excluded.

7. Privacy and communications

Our Privacy Policy explains how personal information is handled. Order and service messages may be sent in connection with your purchases. Marketing subscription choices are separate; you may unsubscribe from marketing emails using their unsubscribe link.

8. Intellectual property

The MODOCasa name, logos, original text, graphics, and product photographs are owned by MODOCasa or used with permission and are protected by applicable intellectual-property laws. Do not reproduce, distribute, or use them commercially without authorization, except as permitted by law.

9. Third-party services

Checkout, payment, reviews, social links, and other features may involve third-party services. Those services may have their own terms and privacy practices. We are not responsible for third-party content that we do not control.

10. Liability

To the extent permitted by applicable law, MODOCasa is not liable for indirect, incidental, or consequential losses arising from use of this website or purchases through it. Our liability concerning an affected order is limited to the amount paid for that order, except where such a limit is prohibited by law.

These limitations do not exclude liability or consumer rights that cannot legally be excluded or restricted.

11. Governing law and updates

These Terms are governed by Texas law, subject to applicable mandatory consumer protections. We may update these Terms and will post the revised version and effective date here. The version in effect when you place an order applies to that order unless applicable law requires otherwise.
